BJ’S HOLIDAY SURPRISE CARD

NO PURCHASE OR PAYMENT OF MONEY NECESSARY TO RECEIVE OR DETERMINE THE VALUE OF YOUR BJ’S HOLIDAY SURPRISE CARD. A PURCHASE OR PAYMENT OF MONEY WILL NOT INCREASE THE VALUE OF YOUR HOLIDAY SURPRISE CARD.

OPEN TO ELIGIBLE LEGAL RESIDENTS OF AZ, CA, CO, FL, IN, KY, LA, NV, OH, OK, OR, TX AND WA WHO ARE 21 YEARS AND OLDER AS OF DATE OF ENTRY.

1. HOW TO PARTICIPATE IN BJ’S "HOLIDAY SURPRISE CARD" PROMOTION ("Promotion"): The Promotion starts 11/17/09 and ends the close of business on 12/13/09 ("Promotion Period"). There are two ways to receive a BJ's Holiday Surprise Card" ("Card"): (A) You will receive a Card when you purchase a BJ’s Gift Card during the Promotion Period worth at least Fifty Dollars ($50); or, (B) You may receive a Card without a purchase by printing your name, complete address (no P.O. Boxes allowed), phone number and age on a 3"x5" card and mailing it along with a self-addressed stamped envelope in a properly stamped outer envelope, to BJ’s Holiday Surprise Card Request, 35610 Mound Road, Dept. 2022, Sterling Heights, MI 48310 postmarked by 12/13/09, and received by 12/20/09. No mechanical reproductions allowed. Each request must be mailed in a separate, properly stamped outer envelope. Sponsor is not responsible for late, lost, misdelivered, illegible or postage due mail. Requests become the property of Sponsor and will not be returned.

2. HOW TO DETERMINE THE VALUE OF YOUR CARD: To determine the value of your Card, visit a BJ’s location between 12/26/09 and 2/28/10, and prior to being seated, present your Card to the BJ's Restaurant Manager and request him/her to swipe your Card to determine if you are a potential winner of the One Thousand Dollar ($1,000) or Five Hundred Dollar ($500) Gift Card or are the recipient of a Ten Dollar ($10) or Five ($5) Discount Card, as described in Rule 3 below.

3. PRIZES/DISCOUNTS: The Prizes available to be won are: One Thousand Dollar Grand Prize Gift Card ("Grand Prize") - 1: One (1) Winner of the Grand Prize will receive a maximum of One Thousand Dollars ($1,000) worth of food purchases at a BJ’s Restaurant. Odds of receiving the Grand Prize are 1:15,000. The potential Winner of the Grand Prize will receive an Affidavit of Eligibility/Compliance & Publicity/Liability Release in the mail, which s/he must sign and return, as allowed by state law, within the time period stated in the notification letter prior to activation of the Gift Card. Failure to sign and return the required documents will result in forfeiture of the Grand Prize. As a special bonus accommodation, BJ’s Restaurants will provide a complimentary meal to the potential Grand Prize Winner, not to exceed fifty Dollars ($50.00), on the occasion that the potential Grand Prize Winner’s Card was scanned. The potential Grand Prize Winner must provide his/her Social Security Number and will receive a Form 1099 in the amount of One Thousand Dollars ($1,000) for tax reporting purposes, as such are required by law. In the event of forfeiture of the Grand Prize, the Grand Prize will not be re-awarded. Five Hundred Dollar First Prize Gift Card ("First Prize") – 10. Ten (10) Winners of the First Prize will each receive a maximum of Five Hundred Dollars ($500) worth of food purchases at a BJ’s Restaurant. Odds of receiving a First Prize are 1:1,500. Discount Card Offers: The Discount Card Offers available to be awarded are (1) a $10.00 off Discount Card good on food purchases of more than $10.00 or (2) a $5.00 off Discount Card good on food purchases of more than $5.00. NOTE: Regardless of the Gift or Discount Card you receive, it may not be used for purchases of alcoholic beverages, gratuities, or taxes. For your Gift or Discount Card to be valid, it must be swiped by a BJ's Restaurant Manager. You are not obligated to make any purchase after the amount of your Discount Card has been revealed. Only one (1) Card per person or party may be used. Cards are for promotional purposes only; they are not transferable or redeemable for cash; and they may not be combined with any other Discount Card, coupon or promotional offer. Lost or stolen Cards will not be replaced. Any balance remaining on the Prize Card or a Discount Card may be applied to future purchases occurring prior to 2/28/10. Any Cards that have been reproduced, tampered with or obtained other than through legitimate and authorized sources are void. All federal, state, and local taxes and other expenses are solely the responsibility of the respective Grand or First Prize Winner or Discount Card recipient. Forfeited, unclaimed or unredeemed Cards will not be re-awarded

4. ELIGIBILITY: The Promotion is open only to individuals who are legal residents of AZ, CA, CO, FL, IN, KY, LA, NV, OH, OK, OR, TX AND WA who are 21 years and older as of date of entry; however, officers, directors, employees and independent contractors (and the household members and immediate family members, e.g. children, spouse, siblings, parents, grandparents and the "steps" of each of the aforementioned) of BJ Restaurants, Inc. ("Sponsor"), PrizeLogic, their parent companies, subsidiaries, affiliates, and their advertising, promotion and web design agencies (collectively, "Sponsor & Others"), and other individuals/entities associated with this Promotion are not eligible to enter or win.

5. RELEASE: Each Grand and First Prize Winner and each recipient of a Discount Card releases and agrees to indemnify and hold harmless Sponsor & Others on an individual and collective basis from and against any and all costs, claims, damages, or any other injury, whether due to negligence or otherwise, to person(s) or property (including, without limitation, death or violation of any personal rights, such as violation of right of publicity/privacy, libel, or slander), due in whole or in part, directly or indirectly, to participation in the Promotion, or the receipt, use or misuse, of the respective Prize or Discount or any component thereof.

6. LIMITATIONS OF LIABILITY/ INTERNET: Sponsor & Others are not responsible for interrupted or unavailable network server or other connections, miscommunications, failed telephone or computer transmissions or jumbled, scrambled or misdirected entries or transmissions, or for phone, electrical, network, computer hardware or software or program malfunctions, failures or difficulties or for other errors, omissions, interruptions, or deletions of any kind whether human, mechanical or electronic or for any damage to any person’s computer related to participating in the Promotion. Sponsor is not responsible for any typographical or other errors in any Promotion related materials. Participants found tampering with or abusing any aspect of this Promotion, as solely determined by Sponsor, will be disqualified and may be subject to prosecution. If in the judgment of Sponsor, the Promotion is compromised by circumstances which corrupt the administration, security, or fairness of the Promotion, Sponsor reserves the right, in its sole discretion to discontinue, suspend or terminate the Promotion and to proceed in a manner it determines fair and reasonable.

7. DISPUTES: Except where prohibited, by participating in the Promotion, participants agree that: (a) except as otherwise specifically set forth in these Official Rules, any action arising out of or relating to these Official Rules or the rights and obligations of any participant and/or Sponsor shall be filed exclusively in the appropriate United States District Court for the State of California or the appropriate California State Court; and participants hereby consent and submit to the personal jurisdiction of such court for the purposes of litigating any such action, and any right to a trial by jury is hereby waived; (b) any and all disputes, claims, and causes of action arising out of or connected with these Official Rules, and/or the rights and obligations of any participant and/or Sponsor shall be resolved individually, without resort to any form of class action; (c) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred and in no event will participants be entitled to receive attorneys' fees or other legal costs; (d) under no circumstances will participants be permitted to obtain injunctive or other equitable relief and a participant's sole remedy will be an action at law for damages to the extent allowed by sub-paragraphs (c) and (e) of this Rule 7; and (e) under no circumstances will participants be permitted, and participants hereby waive all rights, to: (i) claim punitive, exemplary, special, incidental, indirect and consequential damages and any other damages (whether due to negligence or otherwise), other than for actual out-of pocket costs described in (c) above; and (ii) have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of any participant and/or Sponsor shall be governed by and construed in accordance with the laws of the State of California without giving effect or regard to any principles or doctrines of conflicts of law of the State of California or any other jurisdiction. If any provision or provisions of these Official Rules shall be held to be invalid, illegal, unenforceable or in conflict with the law of any jurisdiction, the validity, legality and enforceability of the remaining provisions shall not in any way be affected or impaired thereby.

8. GENERAL: By participating in the Promotion, entrants agree to these Official Rules and the decisions of PrizeLogic, the independent agency administering this Promotion which are final and binding in all matters and all respects relating to this Promotion. This Promotion is void in all jurisdictions other than those expressly included above and wherever else prohibited by law. Acceptance of a Prize or Discount constitutes the participant’s consent to the use of his/her name, biographical information, photograph and/or likeness for advertising and publicity purposes as determined by Sponsor and its designees and representatives without further compensation, except where prohibited by law. All federal, state and local laws and regulations apply. All entries and/or materials submitted become the property of Sponsor and will not be returned. Sponsor & Others are not responsible for any lost, late, undeliverable/undelivered, or postage due mail.
