BJ’S "FATHER’S DAY SWEEPSTAKES" OFFICIAL RULES

NO PURCHASE OR PAYMENT OF MONEY IS NECESSARY TO ENTER OR WIN.
A PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCE OF WINNING.

OPEN ONLY TO MALE LEGAL RESIDENTS OF AZ, CA, CO, FL, IN, KY, LA, NV, OH, OK, OR, TX, or WA WHO ARE AT LEAST 21 YEARS OF AGE AS OF THE DATE OF ENTRY

1. ELIGIBILITY: BJ’s "Father’s Day Sweepstakes" ("Sweepstakes") is open to all male legal residents of AZ, CA, CO, FL, IN ,KY, LA, NV, OH, OK, OR, TX, or WA who are at least, 21 years of age as of the date of entry, except officers, directors, and employees of BJ’s Restaurants, Inc. ("Sponsor"), its parent, affiliated or subsidiary companies, and its advertising, promotion and web design agencies, including PrizeLogic LLC ("PrizeLogic"); and all other individuals or entities associated with the development, administration, promotion, execution of, or supply to this Sweepstakes (hereinafter referred to as "Sponsor & Others") and members of their household or immediate family, i.e., spouse, parents, children, siblings, the "steps" of each, and persons residing in such immediate family members’ household.

2. TO ENTER: Sweepstakes starts 6/5/09 at 12:00 A.M, ET and ends 6/21/09 at 11:59:59 P.M., ET ("Sweepstakes Period"). Two ways to enter: Either (A) Go to your favorite participating BJ’s Restaurant ("Restaurant") during the Sweepstakes Period, legibly complete an Official Entry Form available at the Host/ess Desk and provide to the store manager prior to the close of business on 6/21/09. No mechanically or otherwise reproduced entries are allowed; or (B) Go to www.bjsrestaurants.com ("Website") during the Sweepstakes Period and register by entering all of the requested information, including selecting your favorite participating Restaurant from the drop-down list. All on-line entries must be received by 11:59:59 P.M., ET, on 6/21/09. Limit: One (1) entry per person throughout the Sweepstakes Period regardless of method of entry and regardless of email address used. All entries become the property of Sponsor and will not be returned. Sponsor & Others are not responsible for incomplete, lost, damaged, stolen, misdirected, late, illegible, or mutilated entries or mail or entries or mail not received by Sponsor.

3. RANDOM DRAWINGS: The names of the potential Grand Prize Winner and potential First Prize Winners will be selected in random drawings conducted by Sponsor in the following manner. FIRST PRIZE DRAWINGS (approximately 84 drawings, based on one (1) drawing per anticipated participating Restaurant): On or about 6/30/09, approximately eight-four (84) separate random drawings, one (1) drawing per anticipated participating Restaurant, will be conducted to select the name of one (1) potential First Prize Winner per Restaurant from among the total number of all entries received for that Restaurant, i.e. entries provided to the store mangaer and on-line entries designating that Restaurant. GRAND PRIZE DRAWING (1): On or about 6/30/09, after the conclusion of the First Prize Drawings, a Grand Prize Drawing will be conducted to select the name of one (1) potential Grand Prize Winner from among the total number of all entries received regardless of method of entry and regardless of Restaurant. Potential winners will be notified on or about 7/1/09 by e-mail/phone or postal mail.

4. PRIZES & ODDS OF WINNING: Grand Prize (1): One (1) Grand Prize Winner will receive a Premier Golf Package consisting of a round of golf (18 holes) for the Grand Prize Winner and three (3) guests at a premier golf course designated by Sponsor, including the use of two (2) golf carts; a VIP dinner for Grand Prize Winner and three (3) guests at a dining location designated by Sponsor; and one (1) Callaway Big Bertha Diablo® Driver. Total Grand Prize ARV: $2,500. All Golf Package arrangements and reservations will be as designated by Sponsor. All expenses not specified above, including but not limited to travel expenses to and from the golf course, golf club rentals, caddy fees, golf lessons, beverages, meals/snacks other than the VIP dinner, souvenirs, personal expenses, gratuities, insurance, and all other expenses incident to the acceptance, participation in and enjoyment of the Grand Prize are solely the Grand Prize Winner’s responsibility. Grand Prize Winner’s guests may not be minors in their respective state of residence unless the Grand Prize Winner is their parent/legal guardian or spouse. Sponsor has no liability for the Grand Prize Winner's inability to utilize the Grand Prize. Should the actual value of the Grand Prize be less than the Approximate Retail Value stated herein, the Grand Prize Winner is not entitled to the difference in value. Sponsor has no liability if the Grand Prize Winner is not able to utilize or enjoy the Grand Prize because of any acts of Force Majeure. The potential Grand Prize Winner will be required to sign and return a notarized Affidavit of Eligibility/Compliance (including providing his/her respective Social Security Number for tax purposes) and a Liability/Publicity Release, as allowed by state law, by the return date specified in the prize notification letter, or s/he will forfeit the Grand Prize and an alternate potential Grand Prize Winner will be selected. The Grand Prize Winner will also be issued a Form 1099 in the amount of the actual retail value of the Prize as required by law. Grand Prize Winner’s guests may also be asked to sign and return a Liability/Publicity Release, as allowed by state law. Odds of winning the Grand Prize depend on the total number of all entries received throughout the Sweepstakes Period. First Prize (approximately 84, based on the award of one (1) First Prize per participating Restaurant): Each First Prize Winners will receive a Callaway® Crimson Putter. ARV: $75 each. Odds of winning a First Prize depend on the total number of all entries received for each participating Restaurant. NOTE: Regardless of Prize won, it is not redeemable for cash; non-transferable or substitutable except by Sponsor, who reserves the right, in its sole discretion, to substitute a Prize or component thereof with one of equal or greater value. All federal, state and local taxes are solely the responsibility of each Winner. Limit of one Prize per person or household address. All Prizes will be awarded.

5. INTERNET/LIMITATIONS OF LIABILITY: Sponsor & Others are not responsible for interrupted or unavailable network server or other connections; for miscommunications; failed telephone or computer transmissions; for jumbled, scrambled or misdirected entries or transmissions; for phone, electrical, network, computer hardware or software or program malfunctions, failures or difficulties; for other errors, omissions, interruptions, or deletions of any kind, whether human, mechanical or electronic; or for any damage to any person's computer related to participating in the promotion. Sponsor & Others are not responsible for illegible, unintelligible, late, lost or stolen entries; for incorrect or inaccurate entry information, whether caused by Internet users or by any of the equipment or programming associated with or utilized in the Sweepstakes; or for any technical, typographical or human errors which may occur in the processing of any entries in this Sweepstakes. Persons found tampering with, abusing any aspect of this Sweepstakes or acting in an unsportsmanlike manner, as solely determined by Sponsor or its representative, will be disqualified and may be subject to prosecution. Any person attempting to enter using multiple email addresses, multiple identities or any other device or artifice to enter multiple times or to interfere with the proper play of this Sweepstakes will be disqualified from participation in the Sweepstakes. If in the judgment of Sponsor or its representative, the Sweepstakes is compromised by virus, bugs, non-authorized human intervention or other causes beyond the control of Sponsor, which corrupts the administration, security, fairness or proper play of the Sweepstakes, Sponsor reserves the right, in its sole discretion, to modify, discontinue, suspend or terminate the Sweepstakes and proceed to select potential winners in a manner it deems fair and reasonable, including the selection of potential winners in a random drawing(s) from among entries received prior to any such modification, discontinuation, suspension or termination. Any personally identifiable information collected during an entrant's participation in this promotion will be collected by Sponsor or its designee and used by Sponsor and its representatives for purposes of the proper administration, fulfillment, publicizing and promotion of the Sweepstakes as described in these Official Rules, as stated in Sponsor’s Privacy Policy at www.bjsrestaurants.com, or as otherwise expressly consented to by entrant during any separate opt-in opportunity provided to entrant during entry into the Sweepstakes. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES (INCLUDING WITHOUT LIMITATION ATTORNEYS’ FEES) FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. In the event of a dispute as to the identity of a Winner based on an email address, the winning entry will be declared made by the authorized account holder of the email address submitted at time of entry. "Authorized account holder" is defined as the natural person who is assigned to an email address by an Internet access provider, on-line service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address.

6. RELEASE: By participating in the Sweepstakes, all entrants, including without limitation the Winners, thereby release, indemnify and hold harmless Sponsor & Others from any and all liability injuries, claims, damages, losses, or causes of action of any kind, whether to property or person, arising directly or indirectly out of the acceptance, possession, enjoyment, use and/or misuse of any Prize or component of any Prize including without limitation travel to, attendance at and participation in Sweepstakes-related events, whether or not sponsored by Sponsor & Others and participation in this Sweepstakes including without limitation personal injury, death, property damage, defamation, infringement of intellectual property rights, and claims based on the rights of publicity, misappropriation of personality and privacy.

7. GENERAL: By entering the Sweepstakes, entrants agree to be bound by these Official Rules and the decisions of Sponsor which shall be final and binding in all matters pertaining to this Sweepstakes. By accepting a Prize, each Winner grants Sponsor and its designees the right to use his/her individual name, address, biographical information, photograph, and likeness for advertising, publicity & promotion purposes and for any other such purposes as Sponsor so determines, in any and all media worldwide without limitation, without further compensation, permission or notice, except where prohibited by law. SPONSOR & OTHERS MAKE NO WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT AS REGARDS ANY PRIZE OR ANY COMPONENT OF THE GRAND PRIZE. AS SOME JURISDICTIONS MAY NOT ALLOW LIMITATIONS OF DAMAGES OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES, YOU WOULD HAVE TO CHECK YOUR LOCAL LAWS TO LEARN IF ANY OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. The interpretation of these Official Rules shall be governed by the laws of the State of Michigan. Any and all disputes, claims and causes of action arising out of, or connected with, the Sweepstakes or any Prize awarded shall be resolved individually and without resort to class action, in the appropriate courts in the State of Michigan exclusively. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or a party's rights and obligations, shall be governed by, and construed in accordance with, the laws of the State of Michigan, without giving effect to any choice of law or conflict of law rules of any other jurisdiction. All federal, state and local laws and regulations apply. Void in all jurisdictions other than those expressly included above and where prohibited or restricted by law.
